TERMS OF SERVICE

This Terms of Use Agreement ("Agreement") is a legally binding agreement between TheRVnetwork.com LLC ("TheRVnetwork") and you, the member ("Member"), regarding your use of the TheRVnetwork.com Web Site and any services, features, contents or applications offered at the TheRVnetwork.com domain and related sub-domains (collectively the "Web Site"). By using the Web Site, you agree to be bound by the terms of this Agreement. TheRVnetwork.com™ may change, modify, add, or delete portions of this Agreement from time to time and such changes shall be effective upon posting on the Web Site. Your continued use of the Web Site after such changes constitutes your acceptance of the new Agreement.

TheRVnetwork.com™ provides access to various publishing and communication tools which Members can use to publish or display (hereinafter "post" messages, photographs, audio and video files (hereinafter "Content" to a webpage and participate in web-based discussions via TheRVnetwork.com’s™’ instant message service. For purposes of this Agreement, the term "TheRVnetwork.com™" shall mean TheRVnetwork.com’s™’ websites (including, but not limited to TheRVnetwork.com). TheRVnetwork.com’s™’ instant message service, and all other software, features, tools, websites and services provided by or through TheRVnetwork.com from TheRVnetwork.com™.

By using TheRVnetwork.com™, you represent and warrant that all registration information is truthful and accurate and that you agree to maintain the accuracy of such information. You further represent and warrant that you are 14 years of age or older and that your use of TheRVnetwork.com™ does not violate any law or regulation in the United States or any other applicable jurisdiction. Your membership may be terminated without warning if it is found that you are misrepresenting your age or your identity. . If you provide any registration information that is untrue or inaccurate, or if TheRVnetwork.com™ has reason to suspect that such information is untrue or inaccurate, TheRVnetwork.com™ may suspend or terminate your Membership without notice to you.

You will need a valid username and password to use TheRVnetwork.com™. You must have a valid email address in order to register for a username and password on the TheRVnetwork.com website. When registering your username and password, you may not:

(1) select or use a user name of another person with the intention of impersonating that person,
(2) use the username of anyone else without authorization,
(3) use a username in violation of the intellectual property rights of any person or entity, or
(4) use a username that TheRVnetwork.com™ considers in its sole discretion as being inappropriate.

Your membership is solely for your personal use and is not transferable. You shall not authorize others to use your username. You are solely responsible for the use and maintenance of your username and password. You may change your password at any time (by going to the TheRVnetwork.com home page and clicking on "Edit Profile". You agree to notify TheRVnetwork.com™ of any unauthorized use of your account or any other breach of security.

Conducting yourself at TheRVnetwork.com

TheRVnetwork.com™ is made available for your personal, non-commercial use only. Businesses, organizations or other legal entities may not use TheRVnetwork.com service for any purpose.

So here’s the obvious but we need to mention it. You may not use TheRVnetwork.com for any illegal or unauthorized purpose. International users agree to comply with all local rules regarding online conduct and acceptable content, including laws regulating the export of data from your country of residence, so we suggest you check with your own laws before using. You are solely responsible for your conduct and any data, text, information, photos, links and other content ("Materials") that you submit, post, and display on the TheRVnetwork.com™ service.

We may, but shall have no obligation to, remove but not limited to materials such as images videos and chat discussions that we determine in our sole discretion are unlawful, fraudulent, threatening, libelous, defamatory, obscene or otherwise objectionable, or infringes or violates any party\'s intellectual property or other proprietary rights or these Terms of Service. Basically if it should not be there don’t put it there or it will be removed.

Other examples of illegal or unauthorized uses include, but are not limited to:

1. Modifying, adapting, translating, or reverse engineering any portion of the TheRVnetwork.com service;

2. Removing any copyright, trademark or other proprietary rights notices contained in or on the TheRVnetwork.com service;
Using any robot, spider, site search/retrieval application, or other device to retrieve or index any portion or the TheRVnetwork.com service;

3. Collecting any information about other members (including usernames and/or email addresses) for unauthorized purposes;

4. Upload, post, transmit, share or otherwise make available any material that contains software viruses or any other computer code, files,

5. Destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

6. Register for more than one User account, register for a User account on behalf of an individual other than yourself, or register for a User account on behalf of any group or entity;

7. Upload, post, transmit, share, store or otherwise make available any content that we deem to be harmful, threatening, unlawful, defamatory, infringing, abusive, inflammatory, harassing, vulgar, obscene, fraudulent, invasive of privacy or publicity rights, hateful, or racially, ethnically or otherwise objectionable;

8. Reformatting or framing any portion of the web pages that are part of the TheRVnetwork.com service;

9. Creating user accounts by automated means or under false or fraudulent pretenses;

10. Creating or transmitting unwanted electronic communications such as "spam," or chain letters to other Members or otherwise interfering with other member\'s enjoyment of the service. This includes the harvesting of e-mail addresses or collection of information for purposes of sending unsolicited e-mails or unsolicited communications

11. Submitting materials of any third party without such third parties prior written consent;

12. Directing any user (for example, by linking) to any materials of any third party without such third parties prior written consent

13. Any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights you will not use or attempt to use another Members account or create a false identity on the Web Site submitting materials that falsely express or imply that such materials are sponsored or endorsed by TheRVnetwork.com™; submitting materials that infringe, misappropriate or violate the intellectual property, publicity, privacy or other proprietary rights of any party; transmitting any viruses, worms, defects, Trojan horses or other items of a destructive nature; submitting materials that are unlawful or promote or encourage illegal activity; or submitting false or misleading information upload, post, transmit, share, store or otherwise make available any videos other than those of a personal nature that:

(i) are of you or your friends,

(ii) are taken by you or your friends, or

(iii) are original art or animation created by you or your friends

This Agreement shall remain in full force while you use TheRVnetwork.com™ and/or are a member. You may terminate your membership at any time, for any reason by sending a request to cancel your account by email to support@TheRVnetwork.com. We may terminate your membership and cancel your user name for any reason with or without notifying you. In the event your membership is terminated or your user name is cancelled, TheRVnetwork.com™ may, without notification, delete the content posted by you, and you will need to re-register for a membership and obtain a new user name to gain access to any registration based service of TheRVnetwork.com™. TheRVnetwork.com™ shall not be responsible for any losses, damages, claims and actions of any kind, either directly or indirectly related to or arising from the restriction, suspension, or termination of access to TheRVnetwork.com™ or cancellation of your user names.

You must use your user name on a regular basis by logging into TheRVnetwork.com.com in order to keep your user name and membership active. TheRVnetwork.com™ may, without notification, cancel your membership and user name and delete the Content Posted by any Member who has not used such user name for a period of ninety (90) days. If your user name is cancelled, you will need to re-register for a membership and obtain a new user name to gain access to any registration based service of TheRVnetwork.com™.

TheRVnetwork.com™ in its sole discretion shall have the right (but not the duty) to monitor the content posted on TheRVnetwork.com™. TheRVnetwork.com™ reserves the right to remove content that, in its sole judgment, does not meet its standards or does not comply with this agreement, or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of others, but TheRVnetwork.com™ is not responsible for any failure or delay in removing such content.

TheRVnetwork.com™ is concerned about the safety and privacy of all TheRVnetwork.com™ users, especially children. However, it is important to keep in mind that TheRVnetwork.com™ is intended for broad general use and users may find that some content available on TheRVnetwork.com™ is offensive, indecent or objectionable. TheRVnetwork.com™ cannot be held responsible for any content posted by TheRVnetwork.com™ users which may be offensive, indecent or objectionable. While TheRVnetwork.com™ has established rules keeping children under the age of 14 from becoming a member,  it is easy for children to lie about their age and thus gain access to content which may be inappropriate and unintended for them. It is up to parents to properly supervise their children’s on-line activities. Certain parental control protections are commercially available which can assist parents in supervising their children’s on-line activities such as computer hardware, software, and filtering services which can be used to block a child’s access to websites such as TheRVnetwork.com.com.

You are solely responsible for all content posted under your user name, including but not limited to photographs, audio, and video recordings as well as interactions with other members. You may use TheRVnetwork.com™ for lawful purposes only. You may not post or transmit any material that (1) contains viruses, Trojan horses, worms, time bombs, cancelbots, or any other harmful programs, (2) harasses, threatens, or abuses another person, (3) is libelous, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane, indecent or otherwise objectionable, (4) violates any applicable law restricting the export or import of data, software, or any other content, or encourages conduct that would constitute a criminal offense, (5) gives rise to civil liability, or otherwise violates any applicable local, state, national or foreign law or regulation. You also may not use TheRVnetwork.com™ to disrupt a third party\'s access and use of TheRVnetwork.com™, or use TheRVnetwork.com™ in a way that may cause interruption of the TheRVnetwork.com.com website or any other service provided by TheRVnetwork.com™.

h. TheRVnetwork.com™ uses the TheRVnetwork.com Video Player (the "Player"), and content delivery network (the "WEBSITE") to provide its video feature on the Website and as part of the Service. Accordingly, your use of the Website and/or the Service, thereby constitutes your agreement to the following terms and conditions:
by uploading Content to the site, you are directing and authorizing TheRVnetwork.com to, and granting TheRVnetwork.com and its contractors a royalty-free, perpetual, non-exclusive right and license to, host, cache, route, transmit, store, copy, distribute, perform, display, reformat, excerpt, analyze, and create algorithms based on the Content in order to
(a) host the Content on the WEBSITE servers and on other computers within the WEBSITE,
(b) index the Content;
(c) display, perform and distribute the Content through the WEBSITE; and
(d) to distribute copies of the Content to through whom You uploaded the Content to the WEBSITE.

TheRVnetwork.com is not responsible for any loss, theft or damage of any kind to the Content.

You further represent and covenant that

(a) the upload, public display, public performance, distribution and reproduction of the Content on the WEBSITE does not and will not violate any applicable law, statute, ordinance or regulation, or breach any duty toward or rights of any person or entity including, without limitation, rights of intellectual property, publicity or privacy, or rights or duties under consumer protection, product liability, tort or contract theories; and

(b) the Content is not, in whole or in part, pornographic or obscene

TheRVnetwork.com shall have the right, as per 512 of the Digital Millennium Copyright Act of 1998 (the "DMCA"), 17 U.S.C. 512 et seq., with appropriate notice to remove, take down or otherwise disable Content that is claimed to be infringing, irrespective of whether Content is ultimately determined to be infringing, and that TheRVnetwork.com shall be in compliance with 512(c)(2) of the DMCA by sending written notice to a user’s last known email and/or U.S. mailing address (or in care of the Site through which User uploaded the Content to the WEBSITE) detailing the alleged infringement.

Your act of installing and/or using any portion of the site indicates your agreement with TheRVnetwork.com\'s privacy policy located at http://www.thervnetwork.com/privacy. In accordance with the privacy policy, TheRVnetwork.com may use information that You provide to TheRVnetwork.com.

TheRVnetwork.com’s sole obligation with respect to uploaded Content in the event of its discontinuation shall be to make commercially reasonable efforts to transfer copies of all uploaded content to TheRVnetwork.com™ through whom you obtained. You agree that TheRVnetwork.com may place, enable and otherwise cause to be displayed advertisements and/or communications from TheRVnetwork.com and its advertisers in, through or in connection with the Publisher, the Player, the WEBSITE and any Content, including but not limited to videos uploaded by You. The selection, placement and timing of such advertisements and/or communications shall be determined by TheRVnetwork.com in its sole discretion. Comments and requests relating to such advertisements and communications may be made to TheRVnetwork.com at support@TheRVnetwork.com.com. TheRVnetwork.com may provide, or third parties may provide, links to other websites or resources. TheRVnetwork.com has no control over such sites and resources. Therefore, You acknowledge and agree that TheRVnetwork.com is not responsible for the availability of such external websites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such websites or resources. In addition, You acknowledge and agree that TheRVnetwork.com shall have no responsibility or liability whatsoever for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such website or resource. All correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Publisher, the Player, the website and any content, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser.

Rights to Content Posted to Public Areas

 If you use TheRVnetwork.com™ to post content or other information to public areas, other people will have access to this information and content. You may only Post to public areas, content that you created or which the owner of the Content has given you permission to Post. By posting content to public areas, you represent and warrant that you own the rights to this content or are authorized to use and distribute this content to public areas. You further represent and warrant that this content does not and will not infringe any other third party right nor violate any applicable law or regulation. You or the owner of the content retain ownership of all right, title and interest in content that you post to public areas. However, by submitting or posting content to public areas, you grant TheRVnetwork.com™, its affiliates, subsidiaries, assigns, agents and licensees the irrevocable, perpetual, worldwide right to reproduce, display, perform, distribute, adapt and promote this content in any medium. This includes, but is not limited to a right to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate, and reformat the Content. You will not be compensated for any content which you Post to public areas.

Proprietary Rights in Content Created by TheRVnetwork.com™

 You understand and agree that TheRVnetwork.com™ owns and retains all proprietary rights in the Website and the Service. The Website and the service contain copyrighted material (including but not limited to graphic designs, source code, member-created content, and compilations of individual data), trademarks, trade dress, and other proprietary information of TheRVnetwork.com™ (collectively, "Proprietary Information"). Except for that information which is in the public domain or licensed by you to TheRVnetwork.com™ (as set forth below and for which you have legal authority to license) or for which you have been given written permission by the management of TheRVnetwork.com™, you may not copy, modify, publish, transmit, distribute, publicly perform, display, reverse engineer, create derivate works of, sell, or otherwise exploit any Proprietary Information. In addition, you may not attempt to discover any source code used in connection with the Website and/or the Service. By agreeing to the terms herein, TheRVnetwork.com™ grants you a limited, non-transferable, revocable, and non-exclusive license to reproduce and display the interface of the Website and/or the Service and content posted thereon (excluding any source code) solely for your personal use in connection with viewing the Website and using the Service.

Prohibition of Spam, Bulk Email and Bulk Instant Messaging

 You may not use TheRVnetwork.com™ to send unsolicited bulk communications. You may not authorize others to use your Membership or user name to send unsolicited bulk communications or cause unsolicited bulk communications to be sent by someone else. You may not harvest or collect information about TheRVnetwork.com™ Members and users, including user names, and use that information for the purpose of sending unsolicited bulk communications. Any violation of these provisions may result in immediate termination of your account, without notice, and further legal action.

Modifications

TheRVnetwork.com™ may, in its sole discretion and without prior notice, (a) revise this Agreement; modify TheRVnetwork.com™, and discontinue TheRVnetwork.com™ at any time. TheRVnetwork.com™ shall post any revision to this agreement to the TheRVnetwork.com.com website, and the revision shall be effective immediately upon such posting. You agree to review these Terms of Use and other online guidelines posted on the TheRVnetwork.com.com website periodically to be aware of any revisions. You agree that, by continuing to use or access TheRVnetwork.com™ you shall abide by any such revision. TheRVnetwork.com™ shall not be liable for any damages or losses related to the modification, cancellation or termination of TheRVnetwork.com™ and/or this Agreement.
